1. Who we are Franchise Community is a website operated by Catriona Robson-Scarborough, a sole trader trading as Franchise Community ("we", "us", "our").

2. About these terms These terms and conditions govern your use of the Franchise Community website. By accessing or using the site, you confirm that you accept these terms and agree to comply with them. If you do not agree, please do not use the site.

We may update these terms from time to time. The version published on this page at the time you use the site is the version that applies. We will change the "last updated" date whenever we make a change, and material changes will be flagged on the site.

3. What Franchise Community is Franchise Community is a free-to-use directory and information resource for the UK franchise industry. It brings together listings for franchise brands, consultants, resellers, networks, events, associations, brokers, service providers, media and related organisations in one place.

What we are not. We are not a franchise broker, franchise consultant, financial adviser, legal adviser or regulator. We do not sell franchises, negotiate on behalf of any party, or receive commission on franchise sales arising from listings on this site. Nothing on the site is advice of any kind, and nothing on the site should be treated as a recommendation to buy, sell, join or invest in any franchise or to engage any listed business.

Always take your own advice. Buying a franchise is a significant financial and legal commitment. You should always take independent legal and financial advice before entering into any franchise agreement or making any investment decision, and carry out your own due diligence on any business you find through this site.

4. Directory listings

4.1 How listings get onto the site Listings on Franchise Community come from two sources:

Listings we have compiled. Some listings have been researched and created by us from information that is already publicly available, such as a business's own website, public directories and public social media profiles. We create these to make the directory useful from day one. Listings submitted to us. Some listings have been submitted by the business itself, or by someone acting on its behalf.

A listing does not mean the business has paid us, partnered with us, or asked to be listed.

4.2 No endorsement Inclusion in the directory is not an endorsement, recommendation, accreditation or approval by us. We do not vet, verify, accredit or audit the businesses listed. We make no representation about the quality, legality, financial standing, regulatory status, accreditation, solvency or suitability of any listed business, and no representation that any listed business is a member of any trade association or holds any qualification it may claim.

Any dealings you have with a listed business are entirely between you and that business. We are not a party to those dealings and accept no responsibility for them.

4.3 Accuracy We take reasonable care when compiling listings, but we cannot guarantee that any listing is accurate, complete or up to date. Information changes, businesses close, contact details move and details submitted to us may be wrong. You should verify anything that matters to you directly with the business concerned before acting on it.

4.4 If your business is listed and you would like it changed or removed If your business appears on Franchise Community and you would like the listing amended, claimed or removed entirely, email us at hello@franchisecommunity.co.uk with the name of the business and what you would like changed. We will action reasonable requests, and we will remove a listing at the request of the business it relates to, normally within 5 working days of receiving the request.

You do not need to give a reason to have your listing removed.

5. Submitting a listing If you submit a listing, or ask us to amend one, you confirm that:

you are the business concerned or are authorised to act on its behalf the information you provide is accurate, complete and not misleading you own or have permission to use everything you send us, including logos, images, text and trade marks the content does not infringe anyone else's rights and does not breach any law, regulation or advertising code any claims you make about your business, including awards, accreditations, memberships, results and earnings, are true and can be evidenced on request

You grant us a non-exclusive, royalty-free licence to publish, display, store, reproduce and adapt the material you submit for the purpose of operating and promoting Franchise Community. This licence ends when the listing is removed, except that we may retain copies in backups and records for a reasonable period.

You are responsible for keeping your listing up to date. Please tell us if anything changes.

6. Refusing, editing and removing listings We may refuse, edit, suspend or remove any listing at any time, at our discretion and without notice, including where we believe it is inaccurate, misleading, unlawful, offensive, in breach of these terms, or the subject of a credible complaint. We are not obliged to give reasons, and we are not liable to you for doing so.

Publishing the directory free of charge does not oblige us to list, or continue to list, any particular business.

7. Complaints about a listing If you believe a listing is inaccurate, misleading, infringes your rights or should not be on the site, email hello@franchisecommunity.co.uk with the listing name, the problem, and any evidence you have. We will review it and take whatever action we consider appropriate, which may include amending the listing, removing it, or leaving it in place.

8. Acceptable use You may use Franchise Community for your own business or personal research. You may not:

scrape, harvest, copy or systematically extract the directory or any substantial part of it, whether by automated means or otherwise use the site or its contents to build a competing directory or database use contact details found on the site to send unsolicited marketing, spam or bulk communications misuse the site by knowingly introducing viruses or other malicious material, or attempt to gain unauthorised access to the site or its infrastructure use the site in any way that is unlawful, fraudulent or harmful, or in connection with any unlawful or fraudulent purpose

We may withdraw or restrict your access to the site if you breach this section.

9. Intellectual property The Franchise Community name, branding, site design, and the compilation, selection and arrangement of the directory belong to us or are licensed to us. You may view and print reasonable extracts for your own use. You may not otherwise reproduce, republish or commercially exploit the site or its contents without our written permission.

Trade marks, logos and content belonging to listed businesses remain the property of those businesses and are shown for identification purposes.

10. Links and third-party platforms The site contains links to third-party websites, platforms and services, including the websites of listed businesses and any community or membership platform we may operate elsewhere. Those links are provided for convenience only.

We have no control over third-party sites or platforms and accept no responsibility for their content, availability, products, services or practices. When you leave Franchise Community you are subject to the terms and privacy policy of the site or platform you go to, and you should read them. Any paid membership, subscription or service you take out on a third-party platform is governed by that platform's own terms, not by these terms.

11. Availability of the site We provide the site free of charge and give no guarantee that it will be available, uninterrupted or error-free. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, and we will try to give reasonable notice where we can.

The site is hosted and delivered using a third-party directory platform, and its availability depends in part on that provider.

12. Our liability Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that:

We provide the site and its content on an "as is" basis and exclude all implied warranties and representations to the fullest extent permitted by law. We are not liable for any loss or damage arising from your dealings with, or reliance on, any business listed on the site. We are not liable for any business loss, including loss of profits, loss of business, loss of contracts, loss of anticipated savings, loss of goodwill, or loss of or corruption of data. Where we are found liable to you, our total liability arising out of or in connection with your use of the site is limited to £100.

If you are using the site as a consumer rather than for business purposes, nothing in these terms affects your statutory rights.

13. Indemnity If you submit a listing or any other content to us, you agree to indemnify us against any claims, losses, damages, costs and expenses (including reasonable legal costs) arising from that content or from your breach of these terms.

14. Your data Our use of personal data is set out in our Privacy Policy, which forms part of these terms. Our use of cookies is set out in our Cookies Policy.

15. General If any provision of these terms is found to be unenforceable, the rest continue to apply.

If we do not enforce a right immediately, that does not mean we have waived it. We may transfer our rights and obligations under these terms to another organisation. You may not transfer yours without our written permission. These terms are between you and us. No other person has any right to enforce them.

16. Governing law These terms and any dispute arising out of them or your use of the site are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
